1. Acceptance of Terms
By accessing or using BadBots.ai (the "Service"), operated by Dr. Lead Flow LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
BadBots.ai is an AI chatbot quality assurance and auditing platform. We provide automated "mystery shopping" for AI chatbots deployed on GoHighLevel (GHL) and other supported platforms. Our Service includes:
- Automated testing of AI chatbots across 8+ channels (Live Chat, SMS, Facebook Messenger, Instagram, WhatsApp, Google Business Messages, Email, TikTok).
- 4-dimension grading rubric: KB Accuracy (40%), Action Correctness (30%), Tone and Personality (20%), Safety (10%).
- 100+ test scenarios covering knowledge base queries, appointment booking, objection handling, edge cases, and safety checks.
- Audit reports with pass rates, dimension breakdowns, failure analysis, and priority fix recommendations.
- Agent management, knowledge base tools, and conversation monitoring.
3. Account Registration
To use the Service, you must create an account. By registering, you agree to:
- Be at least 18 years of age.
- Provide accurate, current, and complete registration information.
- Maintain the security and confidentiality of your account credentials, including your password and any API tokens.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Subscription Plans and Payment
BadBots.ai offers the following subscription plans:
- Solo — $97/month: For individual GHL users managing a single sub-account.
- Team — $297/month: For teams managing multiple sub-accounts with collaboration features.
- Agency — $597/month: For agencies managing client accounts at scale with advanced reporting and white-label options.
Billing: Subscriptions are billed monthly or annually via Stripe. Annual plans receive a discount equivalent to 2 months free.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Free Trial / Early Access: We may offer limited free access during our early access period. Free access may include usage limits on audit runs, connected accounts, and available features. We reserve the right to modify or discontinue free access at any time.
Price Changes: We reserve the right to change subscription pricing with 30 days' written notice. Price changes take effect at the start of your next billing cycle.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Test GHL accounts you do not own or have explicit written authorization to test.
- Use the Service to attack, disrupt, overload, or spam any third-party service, including GoHighLevel or any connected platform.
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of our grading algorithms, scenario library, or any part of the Service.
- Use automated scripts, bots, or scrapers to access or extract data from the Service without our written permission.
- Share your account credentials, API tokens, or Private Integration Tokens with unauthorized parties.
- Resell, redistribute, or sublicense access to the Service without a written agreement.
- Use the Service in any way that violates applicable local, state, national, or international laws or regulations.
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions.
6. GoHighLevel Integration
By connecting your GoHighLevel account to BadBots.ai, you acknowledge and authorize the following:
- Account Access: You provide us with a GHL Private Integration Token (PIT) that grants access to your GHL sub-account. We use this token to read agent configurations, knowledge bases, and conversation data.
- Test Contact Creation: During audits, we create temporary synthetic contacts in your GHL account. These contacts do not have phone numbers and are deleted immediately after each test scenario completes.
- Message Injection: We inject test messages into conversations with your AI chatbot to evaluate its responses. In sandbox mode, this uses GHL's internal messaging and does not trigger SMS, email, or other outbound channels.
- Configuration Reading: We read your agent settings (name, goals, personality, instructions, channels), knowledge base content, and conversation actions to provide accurate grading and reporting.
- PIT Scope Responsibility: You are responsible for ensuring your PIT has the appropriate scopes enabled for the features you use (contacts, conversations, calendars, workflows, knowledge bases, etc.).
We access your GHL account solely to perform the services you request. We do not modify your production agent configurations unless you explicitly initiate such changes through our platform.
7. AI-Generated Content
Our audit reports, grades, and recommendations are generated by artificial intelligence. You acknowledge that:
- Audit grades are AI-generated assessments based on our 4-dimension rubric. They represent a quality indicator, not a guarantee of chatbot performance.
- Our grading rubric, weightings, and scenario library may evolve over time as we improve our methodology. Grade comparisons across different rubric versions should account for this.
- AI-generated results should inform your decisions but are not a substitute for human judgment. We recommend reviewing flagged conversations and applying your own business context.
- We use Anthropic's Claude API (and may add OpenAI, Google, or other providers) for grading. These third-party AI providers process test conversation data according to their own terms and privacy policies.
8. Intellectual Property
Our Property: The Service, including all software, grading algorithms, scenario library, report templates, user interface design, documentation, branding, and trademarks, is owned by Dr. Lead Flow LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.
Your Property: You retain full ownership of your GHL account data, agent configurations, knowledge base content, business information, and any content you create outside of the Service.
Audit Reports: Audit reports generated by the Service are licensed to you for internal business use and client-facing presentations. You may share audit reports with your clients and team members. You may not resell raw report data or use it to build a competing product.
Feedback: If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation to compensate you.
9. Data and Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you agree to the data practices described in the Privacy Policy.
By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing, improving, and supporting the Service.
10. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted access. You acknowledge that:
- Scheduled maintenance: We may perform maintenance with reasonable advance notice. When possible, maintenance will be scheduled during low-usage periods.
- Third-party dependencies: The Service depends on GoHighLevel's API, Supabase, Vercel, Cloudflare, Stripe, and AI provider APIs. Outages of these services are outside our control and are not considered a breach of these Terms.
- Feature changes: We may modify, add, or remove features at any time. We will provide reasonable notice for the removal of significant features.
11. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the maximum extent permitted by law, Dr. Lead Flow LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, data, or business opportunities.
- Business interruption or operational downtime.
- Incorrect audit grades, missed chatbot failures, or inaccurate recommendations.
- GHL API outages, rate limits, or service degradation.
- Actions taken by your AI chatbot in response to real customer interactions.
- Damages resulting from unauthorized access to your account due to compromised credentials.
Maximum liability: Our total aggregate liability for any claims arising from your use of the Service shall not exceed the total amount you paid to us in the 12 months immediately preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Dr. Lead Flow LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights, including GoHighLevel terms of service.
- Testing of GHL accounts you were not authorized to access.
- Any claim by a third party related to your chatbot's behavior or your business practices.
13. Termination
By You: You may cancel your subscription and close your account at any time through account settings or by emailing [email protected]. Cancellation takes effect at the end of the current billing period.
By Us: We may suspend or terminate your access for violation of these Terms. For non-critical violations, we will provide 7 days' written notice and an opportunity to cure. For critical violations (fraud, abuse, illegal activity), we may terminate immediately.
Effect of Termination: Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days to allow for export or recovery, after which it will be permanently deleted. You may request a data export before the 30-day period ends.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
15. Dispute Resolution
Informal Resolution: Before initiating any formal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute in good faith within 30 days.
Binding Arbitration: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Florida, and the arbitrator's decision shall be final and binding.
Class Action Waiver: You agree to resolve disputes on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.
16. Changes to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice via email or a prominent notice within the Service. Non-material changes (formatting, clarifications) may be made without advance notice.
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service before they take effect.
17. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dr. Lead Flow LLC regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
